The Creator Passport LLC Affiliate Partnership Terms and Conditions

By registering as an affiliate (“Affiliate Partner”) with The Creator Passport LLC (“TCP,” “we,” “our,” or “us”), you agree to be bound by these Terms and Conditions (“Agreement”). Please read carefully. If you do not agree, do not participate in the program.

The Creator Passport LLC reserves the right to update and change the Terms of Service from time to time without notice. Continued use of the Program after any such changes shall constitute your consent to such changes.

We have the right to terminate an account for any reason we see fit at any time. Violation of any of the terms below will result in the termination of your Account and forfeiture of any outstanding affiliate commission payments earned during the violation.

ENROLLMENT & ELIGIBILITY: 

We reserve the right to reject any application, however, we encourage you to contact us if you feel we have made an incorrect decision. 

Affiliates must be at least 18 years old and legally able to enter into binding contracts.

Participation requires compliance with all applicable laws, including GDPR, CCPA, and international privacy regulations.

COMMISSION & PAYMENTS:

Participation in the Affiliate Program is granted strictly on an application basis. Approval into a specific commission tier is determined at the sole discretion of The Creator Passport LLC (“TCP”).

Full Launch Runway Partners: Affiliates selected to participate in TCP’s multi-month launch runway promotion will be eligible for the higher commission tier.

Open Cart Partners: Affiliates approved only for the designated open cart week promotion will be eligible for the lower commission tier.

TCP reserves the right to assign, reassign, or revoke an Affiliate’s tier status at any time based on application review, program participation, compliance with these Terms, and overall performance.

Acceptance into the Affiliate Program does not guarantee placement into the higher commission tier. All final decisions regarding tier assignment are made at TCP’s sole discretion and are not subject to appeal.

  • Full Launch Runway Partners: 30% per qualified sale of TCP 5.0 during the promotion period.
  • Open Cart Partners: 10% per qualified sale of TCP 5.0 during the promotion period.

A qualified sale is directly referred by Affiliate Partner to TCP’s Site through the Affiliate Partner’s unique link or cookie. The purchaser MUST use your link in order for the sale to be attributed to you. Verbal or informal referrals without link usage will not qualify. The Affiliate must have been registered in the TCP Affiliate Program prior to Cart Open to be considered an eligible affiliate.

Commissions are not paid on, and will not include, a sale to Affiliate Partner himself or herself; meaning Affiliate Partner cannot purchase the Product for his or her own use or others through his or her link and receive a commission on that sale. All sales and commission numbers are tallied by TCP, and credit due to Affiliate Partner and all the final sales and commission numbers are at the sole discretion of TCP.

TCP is NOT responsible for Affiliate Partner using or maintaining his or her Affiliate Partner links, and only sales tracked through TCP’s system will count towards Affiliate Partner’s commissions. 

TCP makes every reasonable effort to accurately track and pay commissions for all sales that come from Affiliate Partners, but is not responsible, nor under any circumstances will be held liable for, any technical difficulties, outside events, actions by other affiliate partners, or other uncontrollable events that may disrupt or interfere with Thrivecart’s ability to track sales or pay commissions.

If The Creator Passport LLC does not receive payment from a client the affiliate does not receive a commission payout. This could be due to refunds, cancellations, or payments paused temporarily due to financial hardship.

TCP pays affiliates via a PayPal account, provided to us when an Affiliate Partner joins. If the PayPal email changes, it is the responsibility of the affiliate to notify the Affiliate Program to ensure proper commission payments. TCP will not resend payments returned due to incorrect payment email addresses.

Tax Compliance: 

Affiliates must complete all required tax forms (e.g., W-9, W-8BEN) before receiving payments. You are solely responsible for reporting and paying any taxes owed.

AFFILIATE COOKIE POLICY:

We use cookies to track referrals and ensure affiliates are properly credited for sales. Our cookie policy is as follows:

Cookie Duration

When a potential customer clicks on your affiliate link, a tracking cookie is placed in their browser. This cookie is valid for 90 days from the initial click. If the customer makes a purchase within this 90-day window, you will receive credit for the sale.

Attribution Model

We operate on a last-click attribution model. This means that if a customer clicks on multiple affiliate links before purchasing, the most recent affiliate link they clicked within the 90-day period will be credited with the sale.

Cross-Device and Cookie Limitations

Cookies are browser- and device-specific. If a customer switches devices, clears their cookies, or uses incognito/private browsing, tracking may not carry over. In these cases, commissions cannot be guaranteed.

Direct Purchases

If a customer purchases directly from our website without using an affiliate link (and without an active cookie), no commission will be attributed.

Transparency & Compliance

Affiliates are responsible for disclosing their affiliate relationship in compliance with FTC guidelines and applicable international regulations.

SOCIAL MEDIA RESTRICTIONS:

Your participating social media platform may not be:

  • Infringing on our or anyone else’s intellectual property, publicity, privacy or other rights.
  • Private. It must be a public account, business account, or creator account.Violate any law, rule, or regulation.
  • Contain any content, that is defamatory, obscene, threatening, harassing, harmful to minors, or contains nudity, pornography, or sexually explicit materials.
  • Contain any viruses, Trojan horses, worms, time bombs, cancelbots, or other computer programming routines that are intended to damage, interfere with, surreptitiously intercept, or expropriate any system, data, or personal information.

WEBSITE RESTRICTIONS IF APPLICABLE:

Your participating website(s) may not:

  • Infringe on our or anyone else’s intellectual property, publicity, privacy, or other rights.
  • Violate any law, rule, or regulation.
  • Contain any content that is defamatory, obscene, threatening, harassing, harmful to minors, or contains nudity, pornography, or sexually explicit materials.
  • Contain any viruses, Trojan horses, worms, time bombs, cancelbots, or other computer programming routines that are intended to damage, interfere with, surreptitiously intercept, or expropriate any system, data, or personal information.
  • Contain software or use technology that attempts to intercept, divert or redirect Internet traffic to or from any other website, or that potentially enables the diversion of affiliate commissions from another website. This includes toolbars, browser plug-ins, extensions, and add-ons.

LINKING TO OUR WEBSITE:

Your website will not in any way copy, resemble, or mirror the look and feel of our website. You will also not use any means to create the impression that your website is our website or any part of our website including, without limitation, framing of our website in any manner.

You may not engage in cookie stuffing or include pop-ups, false or misleading links on your website. In addition, wherever possible, you will not attempt to mask the referring URL information (i.e. the page from where the click is originating).

Using redirects to bounce a click off of a domain from which the click did not originate in order to give the appearance that it came from that domain is prohibited.

EMAIL:

If you intend to promote our program via email campaigns, you must adhere to the following: Email must be sent on your behalf and must not imply that the email is being sent on behalf of The Creator Passport LLC.

REVERSAL & COMMUNICATION POLICY:

We reserve the right to reverse orders due to order cancellations, duplicate tracking, returns, disputed charges, and program violations as outlined in these terms and conditions. If we ask you for clarification or more information on any orders or clicks that we suspect may be in violation of our terms and conditions, we expect that you will respond in a timely and honest manner. Below are violations of our communications policy. If any of the following apply, then we reserve the absolute right to reverse orders or suspend you from the program.

1. You are not forthcoming, intentionally vague, or are found to be lying.

2. You are not responsive within a reasonable time period.

3. You cannot substantiate or validate the source of your traffic to our program with clear

and demonstrable proof.

Data Privacy & Compliance:

TCP processes affiliate data in accordance with our Privacy Policy.

Affiliates must comply with all applicable privacy and data protection laws (including GDPR). This includes:

  • Obtaining valid consent before placing cookies or collecting personal data from EU/EEA users.
  • Providing clear privacy disclosures to your audience.
  • Respecting user rights to access, correction, and deletion of their personal data.

Affiliates are responsible for ensuring their own compliance with privacy regulations when promoting TCP products.

Limitation of Liability:

TCP is not liable for indirect, incidental, or consequential damages, including loss of profits, arising from participation in the program. Tracking interruptions, system errors, or third-party issues (e.g., PayPal, ThriveCart) do not create liability for TCP.

Governing Law:

This Agreement shall be governed by and construed under the laws of the State of California, United States, without regard to conflict of law provisions.

Entire Agreement:

These Terms constitute the full agreement between you and TCP regarding participation in the Affiliate Program and supersede all prior understandings.
